MyFun.com.au is owned and operated by MyFun Pty Ltd (ABN 57 080 185 593), ("MyFun")
 This document contains the terms and conditions governing your use of this web site and any order or purchase of a product, ticket or booking ("Product") made via this website ("Terms and Conditions"). By using this web site you agree to be bound by these Terms and Conditions.
 
Who may use this site
Children under the age of 16 may not purchase any Product on this site.  If you are under the age of 16 and would like to purchase a Product from this site, please ask your parent or guardian for assistance.
 
Access and Use
You must not use this site in any manner or for any purpose which is unlawful or contrary to these Terms and Conditions.
 
MyFun, in its absolute discretion, reserves the right to refuse any order you place to purchase a Product, competition entry or booking or to deny access to this site for any conduct it believes may breach these Terms and Conditions or any law.
 
The availability of rides, shows and attractions shown or referred to on this web site is subject to change, delay, cancellation or closure due to inclement weather, preventative maintenance, refurbishment or other operational requirements.
 
Competitions may be subject to individual terms and conditions available at the time of entry.
Employees of MyFun and its related bodies corporate, including immediate family members, may become members of MyFun but cannot enter any competitions promoted on the MyFun website.
 
The information on this site is only intended to be of a general nature - detailed particulars can be obtained by contacting the relevant theme park, attraction or vendor business directly.
 
Personal Information
You may be asked to provide personal information (ie. information which is collected and identifiable as relating to you personally) before purchasing any Product, entering any competition or registering for our MyFun e-Newsletter on this web site. All personal information collected from this web site will be maintained in accordance with the MyFun Privacy Statement. By using this site, you consent to MyFun retaining and using your personal information in accordance with the Privacy Policy.
 
Limitation of Liability
Any representation, warranty, condition or undertaking that would be implied in these Terms and Conditions by legislation, common law, equity, trade, custom or usage is excluded to the maximum extent permitted by law.
 
Nothing in these Terms and Conditions excludes, restricts or modifies any condition, warranty, right or remedy which may be conferred by the Trade Practices Act that cannot be excluded, restricted or modified by agreement.
 
To the fullest extent permitted by law, MyFun's liability for a breach of a non excludable condition or warranty is limited, at MyFun's option, to:
 • in the case of goods, any one or more of the following:
 • the replacement of the goods or the supply of equivalent goods;
 • the repair of the goods;
 • the payment of the cost of replacing the goods or of acquiring equivalent goods; or
 • the payment of the cost of having the goods repaired; or
 • in the case of services:
 • the supplying of the services again; or
 • the payment of the cost of having the services supplied again.

Indemnity
You agree to indemnify MyFun for any loss or damage that it may suffer or for any costs it may incur in connection with any breach by you of these Terms and Conditions.
 
Intellectual Property Rights
The content on this site, such as graphics, logos, information, text, video clips, material, software or advertisements ("Content") is protected by Australian and international copyright and trademark law. 
Without the express permission of MyFun, the Content must not be modified, copied, reproduced, republished, framed, uploaded, posted, transmitted or distributed in any way except as expressly provided on this site. 
 
You may, however, download, store in cache, display, print and copy material in a complete and unaltered form for your own personal, non-commercial use provided that you:
 • keep intact all copyright and trademark notices (set out below); & 
 • do not use the material in any manner that suggests an association with any of our products, services or brands. 

Variation
MyFun may vary these terms and conditions at any time. Any variations become effective upon posting. By continuing to use this website following a variation of the terms and conditions, you consent to be bound by the varied terms and conditions.

This website contains hyperlinks and other pointers to web sites operated by third parties ("Hyperlinked Websites").  Unless otherwise stated at those websites, those websites are not controlled by MyFun.  By using those links, you acknowledge and agree that:

MyFun provides these hyperlinks to you as a convenience only, and the inclusion of any link does not imply any endorsement of the Hyperlinked Website by MyFun, its related bodies corporate, affiliates, corporate partners or licensors. Governance
The Terms and Conditions are governed by the laws of the State of Victoria, Australia.  By using this site, you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the State of Victoria.


MyFun Terms of Purchase

These Terms and Conditions apply to the purchase of any and all products using this website, www.myfun.com.au, which is owned and operated by MyFun Pty Ltd (ABN 57 080 185 593). Such products include tickets (including passes), Vouchers, MyFun Gift Cards and /or any other products which can be purchased on this website.
Vouchers are vouchers with denominations (eg, $50, $100) that are specific to certain venues, attractions or theme parks, and cannot be used in any other venue. They can be redeemed (used) at these venues against services and products, unless described otherwise, to the value of the stated denomination.
By purchasing any products on this website, you are agreeing to these Terms and Conditions. The Terms and Conditions are governed by the laws of Victoria and in using this website, you unconditionally submit to the jurisdiction of the courts of Victoria.

1 The following applies to all products purchased on www.myfun.com.au:
            a. All products purchased online are non-refundable.     
            b. All product prices are shown in Australian dollars and are inclusive of GST (if applicable).
            c. Products can be purchased through this website by using credit cards, MyFun Gift Cards, or a combination of these means of payments. Note that:
                    o MyFun Gift Cards may be used to purchase tickets and/or Vouchers; 
                    o However, MyFun Gift Cards cannot be used to purchase MyFun Gift Cards. MyFun Gift Cards must be paid using debit or credit cards.     
            d. Your debit or credit card will be charged at the time of purchase. All debit and credit card purchases are made through our bank’s secure payment facility. All purchases will be charged in Australian dollars and you are solely liable for any potential currency conversion fee charged by your card provider.
            e. If your transaction is successful, you will be sent a confirmation email in the next hour following your purchase. 
                    o If you experience any technical difficulties, please wait sixty minutes and then check to see if you have received your email confirmation before attempting a second transaction.             f. This confirmation email will include any purchased products that are “digital” (meaning that the email itself is the ticket or Voucher), except Digital MyFun Gift Cards. Digital MyFun Gift Cards may be sent to you in a separate email. 
            g. Printer: depending on the type of product you purchase, you may be required to have access to a printer in order to print your product (it is compulsory for all digital tickets and digital Vouchers). Entry/redemption at theme parks or attractions will not be permitted without presentation of these tickets. Print-at-home tickets and digital Vouchers are the responsibility of the purchaser. Please contact customer service via email on info@myfun.com.au, or telephone at 1300 304 798 if you require assistance. 
            h. Physical products (being tickets, Vouchers and MyFun Gift Cards) are shipped the day after a purchase is successfully made. We will send the products using Registered Mail to the address you nominated when completing the transaction. Please allow 10 working days after completing the transaction for the products to arrive. We do not mail internationally at this time. 
            i. Additional fees:
                    o We may charge a credit card surcharge fee per transaction for payments made via credit card. This fee is clearly stated in the checkout summary before you confirm the purchase. 
                    o A web booking fee applies to all transactions. This fee is clearly stated in the checkout summary before you confirm the purchase. 
                    o A postage & handling fee applies to the purchase of physical products (which are shipped to a street address). It includes physical MyFun Gift Cards, physical Vouchers (when available), and some physical tickets. This fee is clearly stated in the checkout summary before you confirm the purchase.
            j. Liability: Our liability is limited to the delivery (be it digital or physical) of tickets, Vouchers and MyFun Gift Cards. We are not liable for the services that are provided by MyFun partners when you are redeeming or using the tickets and / or Vouchers that are purchased on this website. By purchasing these products, you agree and acknowledge that the MyFun partner whose goods or services you intend to use (with your ticket or Voucher) has Terms & Conditions for the specific venue/ service with which you must comply. Any dispute about goods or services provided by MyFun partners against the presentation of a ticket or Voucher that was purchased on www.myfun.com.au, must be resolved directly with the MyFun partners (attractions, theme parks, zoos, entertainment activities, etc). To the extent permitted by the law, our liability is limited to replacing faulty tickets, Vouchers and MyFun Gift Cards.

2 The following applies to tickets and Vouchers only, when they are purchased on www.myfun.com.au:
            a. Some tickets may require a time and/ or date to be selected before purchasing the tickets. When a time and/ or date is selected for a ticket, it is not transferable to another date or time.
            b. All tickets purchased online are non refundable, not exchangeable and cannot be resold.     
            c. Some tickets and Vouchers carry specific restrictions or requirements, which are clearly set out in the Attractions pages. By purchasing a ticket or Voucher with a specific restriction or requirements, you [and where you are under 18 years old, your Parent or Guardian] are accepting these specific restrictions and/ or requirements. The specific restrictions and requirements are stipulated by our MyFun partner (whether it concerns an attraction, theme park or venue) and may include, but are not limited to, safety requirements, physical restrictions, and/or clothing or accessory restrictions that may apply on some rides.

3 The following applies to MyFun Gift Cards only:
            a. MyFun Gift Cards can be purchased on www.myfun.com.au, selected other websites, and in major retail stores.
            b. MyFun Gift Cards can only be redeemed on www.myfun.com.au to purchase any of the available products (excluding other MyFun Gift Cards). MyFun Gift Cards cannot be used directly at any of our MyFun partners’ attractions, sites or venues.
            c. MyFun Gift Cards should be treated like cash. Defaced, mutilated, or altered cards will not be replaced, refunded or redeemed. 
            d. The MyFun Gift Cards cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new MyFun Gift Card, or be replaced after expiry, and are not legal tender, account cards, credit or debit cards or securities. Cash will not be given for any unused amount. Purchases exceeding available balance require difference paid by other method.
            e. Expiry: MyFun Gift Cards expire 12 months from the date of issue, which can be located on the back of the MyFun Gift Card. MyFun Gift Cards are void and cannot be redeemed after their expiry date.
            f. Activation of MyFun Gift Cards:
                o MyFun Gift Cards must be activated prior to use on www.myfun.com.au, as per instructions on the back of the MyFun Gift Card. To activate your MyFun Gift Card, go online to www.myfun.com.au/mygiftcard and follow instructions. Once activated, funds are automatically available, and the MyFun Gift Card can be immediately used.
                o Please note that MyFun Gift Cards which are purchased in retail stores require up to 2 business days from the date of purchase before they can be activated. If you are having difficulty activating your MyFun Gift Card after this time, please return to the retail store from where you purchased the MyFun Gift Card for assistance. 
            g. MyFun Gift Cards cannot be used in conjunction with any other promotional offer, unless otherwise advised on www.myfun.com.au.
            h. Theft, loss:
                o Keep your MyFun Gift Card secure - anyone holding a gift card can use its value to make purchases. If your MyFun Gift Card is lost or stolen, or you suspect an unauthorised transaction, immediately report this by calling 1300 304 798. By providing us with the MyFun Gift Card number, original balance and expiry date, we may attempt to cancel the MyFun Gift Card and therefore prevent the value of the MyFun Gift Card being used. If you are not able to provide us with these details or if a fraudulent transaction has already occurred, we may not be able to assist you and we will not be liable for the loss you have suffered. 
                o We may replace a faulty, lost or stolen MyFun Gift Card. Any replacement MyFun Gift Card will have the same unused value (at the time of replacement) and expiry date. You must present the original receipt and MyFun Gift Card number (located on the back of your MyFun Gift Card). 
                o There is a $10.00 fee to have your MyFun Gift Card cancelled and replaced in addition to the postage and handling fees of the new MyFun Gift Card. These fees may be waived in the case of a proven faulty MyFun Gift Card.
                o MyFun Gift cards will be void if they are defaced, mutilated, altered or tampered with in any way. We may subject MyFun Gift Cards to verification and security checks at our absolute discretion. 
            i. If you have a query or complaint about your MyFun Gift Card, please contact customer service at via email on info@myfun.com.au, or telephone at 1300 304 798. 
            j. We may cancel any MyFun Gift Card, or amend the MyFun Gift Card scheme, for any reason at any time without notice. If so, we may either provide a refund or a replacement gift card of equivalent value unless we reasonably suspect fraud in relation to a MyFun Gift Card. The MyFun Gift Card remains our property.
We reserve the right to change any terms contained in these Terms & Conditions at any time.


MyFun Rewards Terms and Conditions

Use of the Lifestyle Rewards website and Membership Directory is subject to the terms and conditions listed below. Lifestyle Rewards reserves the right to amend these Terms and Conditions at any time, but will endeavour to provide Members with as much prior notice as possible of any change.

1. Legal Notice and Disclaimer
Members must abide by any Terms and Conditions posted on the Lifestyle Rewards Website.
Members’ use of the Lifestyle Rewards website is made at their own risk. Lifestyle Rewards may, from time to time, change or add to this website including the information, products and services contained herein, and will endeavour to provide Members with as much prior notice as possible of any change. While Lifestyle Rewards will make best endeavours to ensure that information on this website is accurate and up to date, Lifestyle Rewards will not be liable to you or to any third party if errors occur in the information on this website or if any information is not up-to-date

2. Disclaimer and Warnings

2.1 Lifestyle Rewards will not be liable for any damage to or any viruses which may affect, your computer on account of your access to this website.
2.2 Lifestyle Rewards is not liable to you or any third party if interference with or damage to your computer systems occurs in connection with the use of this website or linked websites.
2.3 You may not use this website to collect or harvest personal information including Internet addresses about businesses participating in the Lifestyle Rewards program.
2.4 You may not purchase discounted items with the intention of onselling them with the intention of generating profit for yourself, for or on behalf of any other third party.

3. Definitions in this Agreement In these Terms and Conditions:

3.1 ’Lifestyle Rewards’ means Lifestyle Rewards Pty Ltd ABN 96 138 299 288, the operators of Lifestyle Rewards program.
3.2 ‘Card’ means your Lifestyle Rewards card, which carries the ‘Lifestyle Rewards’ logo.
3.3 ‘Member’ means a Lifestyle Rewards member with a current membership number.
3.4 ‘Program’ means the Lifestyle Rewards Program.
3.5 ‘Voucher’ means the Program membership voucher provided by Lifestyle Rewards via the website or by mail on request from you.
3.6 ‘You’ and ‘your’ means you in the capacity of Member.
3.7 ‘Services’ means the discounts and other benefits provided by businesses participating in the Program to Lifestyle Rewards for use in the Program.

4. Acceptance

4.1 Use of the Card by you constitutes your agreement to these Terms and Conditions, which shall govern use of the Card and the provision of the Services. If you do not accept these Terms and Conditions, you must refrain from using the Card.
4.2 The Card remains the property of Lifestyle Rewards Pty Ltd.
4.3 Lifestyle Rewards may, from time to time, change or add to this website, including the information, products or services contained herein, and will endeavour to provide Members with as much prior notice as possible of any change. In any event, your continued use of this website will constitute acceptance of the variation.

5. Warranties

5.1 Lifestyle Rewards does not warrant that any information or service provided or referenced by this website is either merchantable or accurate, that such information or service will fulfil any of your particular purposes or needs, or that such information or service does not infringe on any third party rights.
5.2 While Lifestyle Rewards makes best endeavours to include accurate and up-to-date information on the Lifestyle Rewards website, Lifestyle Rewards makes no warranties or representations as to its accuracy.
5.3 Lifestyle Rewards may periodically add, change, or improve any of the information, products, services, programs and technology described on the Lifestyle Rewards website and will endeavour to provide Members with as much prior notice as possible of any change.
5.4 Lifestyle Rewards assumes no liability or responsibility for any errors or omissions in the content of the Lifestyle Rewards website.

6. Services

6.1 Each business participating in the Program reserves the right to change, modify or cancel the Services offered, and will endeavour to provide Lifestyle Rewards with as much prior notice as possible of any change. Lifestyle Rewards will in turn make best endeavours to provide prior notification to Members of the change.
6.2 The links provided to other websites are done for convenience purposes only and Lifestyle Rewards does not purport to approve or endorse any of the linked materials.

7. Third Parties

7.1 Lifestyle Rewards will not be liable for any mistake, failure or negligent action on the part of any business providing Services in the Program.
7.2 Members agree to enter into any arrangement with a business providing Services in the Program at their own risk.
7.3 Businesses providing Services in the Program reserve the right to change, modify or cancel any offers and will endeavour to provide Lifestyle Rewards with as much prior notice as possible of any change.
7.4 Lifestyle Rewards or any other party involved will not be liable for any direct, indirect, incidental, consequential or punitive damages arising out of your access to, or use of, the Program.
7.5 Under no circumstances will Lifestyle Rewards be liable for any incidental, special or consequential damages, including (for businesses providing Services in the Program) damages, loss of business, or other profits arising in relation to use of the Program, website materials or linked materials.
7.6 In maintaining and operating this website, Lifestyle Rewards relies upon information provided by third parties. Lifestyle Rewards will only provide a guarantee when Members abide by the terms and conditions of the Service offered. Lifestyle Rewards cannot provide a guarantee against loss, liability, damage and expense if the terms and conditions of the Services offered are not met.

8. Termination

8.1 Termination of your Lifestyle Rewards membership is at the discretion of your Club, Association or Organisation.

9. Electronic Listings and Advertisements

9.1 Lifestyle Rewards does not accept responsibility for the accuracy of any listing or advertisement published, and disclaims all liability to advertisers, Members and readers of any kind of loss or damage as a result of inaccuracy, error or omission. The only type of liability Lifestyle Rewards will accept is when the terms and conditions of the Service offered are adhered to. (Please see below)
9.2 Each business providing Services in the Program that lists the Services offered on this website shall own the copyright in the listing or the advertisement.
9.3 The linked websites on this website are provided for convenience only and may not remain current or be maintained. Links to linked websites should not be construed as any endorsement, approval, recommendation, or preference by Lifestyle Rewards of the owners or operators of those sites, or of any information, products or services referred to on those sites.

10. Trade Marks

10.1 Other products and company names mentioned on this website may be the trade marks of other people or entities.

11. Personal Information

11.1 When transacting with you Lifestyle Rewards may ask you for your name, email and Lifestyle Rewards membership number so that you can accurately be identified.
11.2 All information once submitted to Lifestyle Rewards automatically becomes the property of your Club, Association or Organisation and may be used for promotional purposes only. This includes Mobile Phone Numbers and e-mail Addresses that may be used to notify Members of coming promotions and competitions. This information will not be sold or given to a third party.
11.3 Lifestyle Rewards are bound and comply with all relevant company and consumer privacy laws and regulations, including the National Privacy Principles and Information Privacy Principles made under the Privacy Act 1988 (Commonwealth). We will not pass any information provided to us to any 3rd party unless we have the express permission of the provider, or as required by law.

12.  Notice

12.1 Any notice to be given in writing to Lifestyle Rewards should be addressed to Lifestyle Rewards, 500 Chapel Street, South Yarra, VIC, 3141
12.2 Any notice given to you will come directly from Club, Association or Organisation.

13. Delivery

Lifestyle Rewards can not take responsibility for any Gift Card, Vouchers or Tickets that are misplaced, lost or stolen when being sent through Australia Post. On ordering, we offer all members the option of Registered Post at a fee of $2.80 which guarantees that Australia Post will be held liable for all Gift Cards, Vouchers or Tickets that are misplaced or lost when sent via this method.


LIFESTYLE REWARDS OFFER OF GUARANTEE

If a valid Member makes a purchase at any Lifestyle Rewards participating outlet and the offer shown is not honoured, Lifestyle Rewards will reimburse the amount equal to the saving listed. To receive your refund, simply retain your receipt and contact the Customer Service Centre on the 1300 telephone number listed in your brochure or handbook so that Lifestyle Rewards can facilitate your refund.
