TERMS AND CONDITIONS OF SALE
Village Roadshow Theme Parks Pty Ltd ACN 010 919 623 (“we”, “us” or “our”) is the operator of Sea World Resort & Water Park (“the Resort”). We want you to enjoy your stay and ensure there are no surprises in relation to the booking or payment process or whilst you are staying at the Resort. We will provide accommodation and other services to you at the Resort subject to the following terms and conditions and ask that you please read them carefully because the person who makes the reservation will be deemed to have accepted these terms and conditions on behalf of all persons staying under that reservation at the Resort.
Booking a room
To book a room at the Resort you must be at least 18 years of age.
Any quote given at the time of making a reservation is an estimate only and the price and your reservation will only be guaranteed* once full payment is made and your credit card charges successfully processed. The total price of your reservation comprises:-
- the applicable package or room rate multiplied by the number of nights you have reserved and the number of guests staying
- any additional products or services you have selected e.g. fruit platters, massage etc.
No refunds are allowed (subject to any law to the contrary). Please note that when you pay by credit card the charge will appear as “Village Roadshow Theme Parks” on your credit card statement.
Cancellation due to technical error
We reserve the right to cancel or amend your reservation in the event of a computer, website or system error which results in the display or communication of an incorrect room rate or other incorrect details and will advise you as soon as possible after we become aware of any such error
Change to a reservation
If you want to change your reservation we will try to assist you but cannot make any guarantees as any change is subject to availability of an alternate room within the sale period and payment of a $25.00 amendment fee. If you wish to make a change please contact our Reservations Team on 1300 139 677 or your booking agent if you did not book directly with us on our website.
No-Shows or cancellations
If you do not check-in to your room, or you cancel your reservation after you have checked in, you will not be entitled to a refund of any monies you have paid to us (subject to any law to the contrary) and must pay any outstanding monies to us in respect of the total cost of your reservation.
To ensure your identity matches the reservation, and in order to eliminate identity fraud, when you check-in you will be asked to provide photographic identification which we will copy and retain for security purposes. If you are unable to provide such identification then we reserve the right to cancel your reservation without refund (subject to any law to the contrary) or refer you to your booking agent if applicable.
Incidental costs during your stay
Payment by Credit Card
If you wish to charge in-Resort purchases (like restaurants, mini bar etc.) to your room’s account whilst staying at the Resort then at the time of check-in you must produce a valid credit card and pre-authorise $100 worth of charges to that card. If a credit card is unable to be authorised for this amount you will be required to make all payments by cash.
There is a credit limit of $750.00 for any room charges and if you reach this amount a letter will be sent to you at your room asking that you settle all current charges on your account in order to continue your credit facility during your stay. If a third party’s credit card is to be used by you during your stay to pay for purchases at the Resort then a Credit Card Authorisation form must be completed and provided to us 7 days prior to check-in. The Credit Card Authorisation form must be accompanied by a clear photocopy of the front and back of the credit card and the signature on the card must match the signature on the Authorisation form. If the credit card is illegible then the Authorisation form will not be accepted by us.
Payment by Cash
If you wish to pay for in-Resort purchases by cash whilst staying at the Resort then you must pay a $200 room security deposit at the time of check-in and you will not be allowed to charge any in-Resort purchases to your room. The security deposit will be returned to you by cash or EFTPOS (depending upon how you made the initial payment to us) upon check-out once the mini bar in your room has been checked for purchases.

Eviction from Resort
We reserve the right to evict you from the Resort without refund (subject to any law to the contrary) in the event of any behaviour which we deem inappropriate, offensive or unlawful.
Loss of Property
You are responsible for the security of your own personal property. We will not be responsible for the loss of any of your property from your room or elsewhere at the Resort unless it can be attributed to our sole negligence.
If you park your vehicle in the Resort’s car park then you do so at your own risk. We will not be responsible for the loss of or damage to any vehicle, accessory or contents in or on any vehicle.
Smoking is only permitted at the Resort in designated smoking areas. No smoking is allowed in Resort rooms or on balconies. If you smoke in your room we will charge you a cleaning fee.
Use of the water park and attractions at the Resort is at your sole risk. At no time should a parent, guardian or carer allow an infant or person under their care to use such facilities without their direct supervision.
Closure of Resort’s facilities and attractions
Restrictions on access to the Resort’s facilities and attractions (e.g. the water park or restaurants) may be imposed at any time due to safety or operational requirements.
These terms and conditions shall be governed by the laws in force in the State of Queensland, Australia and the courts of appeal therefrom.
We reserve the right to modify or change the terms and conditions at any time without prior notice to you.
If any of these terms and conditions are determined to be invalid or unenforceable pursuant to applicable law by any court of competent jurisdiction the balance terms and conditions will remain in full force and effect. Any term found to be invalid or unenforceable will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.
Subject to any requirements at law to the contrary, in no event shall we be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with our provision of goods or services to you whether based on contract, tort, strict liability or otherwise. Where our liability cannot be excluded, to the extent permitted by law such liability is limited to either to resupply the goods or services or the cost of resupplying the goods or services or otherwise to the value of the goods or services supplied.
If you cancel your reservation after you have checked in you will not be entitled to a refund of any monies you have paid to us (subject to any law to the contrary) and must pay any outstanding monies to us in respect of the total cost of your reservation.
If you have a complaint then we will try to deal with it in an efficient and fair manner without delay. Please direct any complaints to:
